Federal court moves to certify class in Cusip antitrust suit

The SDNY judge has handed a procedural win to plaintiffs, allowing swaths of end-user firms and third-party data vendors to join the class action.

On Friday, Southern District of New York Judge Katherine Failla certified the proposed class in the lawsuit against Cusip Global Services, the American Bankers Association, FactSet, and S&P Global. As part of the order, the case is unstayed and will proceed to trial or settlement talks.

In November, the plaintiffs in the case—Dinosaur Financial, a New York broker-dealer; Swiss Life Investment Management; and Connecticut-based Hildene Capital Management—proposed to represent all firms who paid CGS
